COLORADO - CDPHE ISSUES DRAFT GUIDANCE PER SB20-218

Colorado - So yesterday, CDPHE hosted a stakeholder session on the ongoing issues surrounding gas station and transport truck inspections a penalties. I am informed that this stakeholder meeting was not well attended by the industry.

As you all are aware CWPMA worked with CDPHE to pass SB-218 which among other things required:

(h) THE DIVISION, IN CONSULTATION WITH STAKEHOLDERS FROM GASOLINE DISPENSING FACILITIES AND GASOLINE TRANSPORT TRUCK COMPANIES, AS DEFINED BY REGULATIONS PROMULGATED BY THE AIR QUALITY CONTROL COMMISSION, SHALL DEVELOP DESIGN, OPERATION, AND MAINTENANCE GUIDELINES BY JUNE 30, 2021. THE GUIDELINES WILL ASSIST OWNERS AND OPERATORS OF GASOLINE DISPENSING FACILITIES AND GASOLINE TRANSPORT TRUCKS IN COMPLYING WITH THE REQUIREMENTS OF AIR QUALITY CONTROL COMMISSION REGULATIONS.

After reading through the draft document, clearly, this guidance while perhaps narrowly meeting the letter of the law is wholly insufficient in outlining maintenance guidelines and operation guidelines that our operators can use to demonstrate due diligence.  Clearly restating the general regulations which everyone more or less understands already was not the legislative intent of the bill.

Please feel free to review the comments and feel free to submit comments about the need to develop a collaborative guide for the industry to demonstrate compliance.
