COLORADO - 23-280 - EFFECTIVE ASSESSMENT ON GASOLINE, SPECIAL FUEL AND DYED FUELS

As a reminder CWPMA’s Board initiated this legislation for support and help with the following purposes –  The money is collected in the same manner and at the same time as the existing PFAS assessment and the E.R.S.

Importantly we were able to extend the Petroleum Storage Tank Fund and provide the Committee and the department some additional flexibility which will benefit responsible parties that have releases. Further. we were able to direct some of the money to the Brownfields redevelopment Fund (money which was swept by the state during the pandemic).

  • Continued work and support on the EJMT effort – the second round of analysis is commencing
  • We are going to begin our effort to redesignate the I-70 corridor between 270 and I-25 a petroleum transport route  
  • We were able to reallocate some of the existing dollars we were forced to pay for PFAS mitigation to supporting partner agencies at Colorado state Patrol and CDOT

 

 

 

New Fee on gasoline, special fuel and dyed fuels

 

The General Assembly has passed Senate Bill 23-280, which establishes a new enterprise. The Fuels Impact Enterprise is funded through a $0.006125 per gallon Fuels Impact Reduction Fee (FIRF). The FIRF is due on gasoline, special fuel, and dyed fuels imported into Colorado or removed from a Colorado terminal. 

 

The Fuels Impact Reduction Fee (FIRF) is effective September 1, 2023 and:

·     Will be collected in the same manner as the existing Perfluoroalkyl and Polyfluoroalkyl Substances (PFAS) Fee. 

·     Applies to gasoline, special fuel, and dyed fuels imported into Colorado or removed from a Colorado terminal, including sales to exempt entities. 

·     Exported gallons are not subject to the FIRF.

·     The FIRF does not apply to aviation gasoline, aviation jet fuel, LPG, or CNG/LNG.

 

The Fuels Impact Reduction Fee will be automatically calculated with your fuel distributor return; therefore, changes are not needed to the distributor spreadsheets, web entries, or XML forms. The fee will be reflected in Revenue Online and on the PDF printout of the return.
