COLORADO - GOVERNOR EXTENDS EMERGENCY DECLARATION FOR FUEL SUPPLY (EXPIRES MARCH 2ND)

CWPMA members will note that the order is limited to routes "off the interstate" relative to weight, We have run into significant barriers relative to state authority despite the concerted effort of our regulatory partners and the Governor's office.

CWPMA cannot thank our regulatory partners at CSP, CDPS and OPS as well as permitting help from CDPHE for their help.

I want to thank Colorado Trustee Eric Liebold for this really good piece.   CWPMA remains fully supportive of our partners at Suncor taking all the time necessary to make sure that everything is in order before coming back online.

Our other supplier partners deserve a lot of credit for steeping up and helping cover the gaps.

CWPMA has been advocating for these orders in large part to trigger statutes that provide defenses against allegations of price gouging.  These qualified reasons only exist as protections when an emergency declaration is in effect.

This Declartion Expires on March 2nd.

Gov. Polis Renews Executive Action Related

to Fuel Supply

DENVER - Governor Polis renewed an Executive Order due to ongoing fuel supply chain risk, and activated the State Emergency Operations Plan.

“I have contacted refineries and fuel transportation companies in other parts of the country to minimize any disruption and to maximize distribution of fuel to Coloradans,” the Governor’s Executive Order reads.

“My administration is pursuing every avenue to mitigate the impacts of Suncor’s temporary shutdown, including temporarily suspending statute and making temporary regulatory exemptions to facilitate the expeditious delivery of fuel around the State. State agencies are proactively reviewing additional tools available to ensure that adequate fuel supply can reach distributors throughout the State,” the Governor’s Executive Order continues.

The Governor took swift action in December, verbally declaring a disaster emergency due to fuel supply chain risk and last week the Governor issued an Executive Order memorializing that declaration.
