COLORADO - NEW EGG REGULATION

The Colorado Department of Agriculture has reached to ensure that the members of the Colorado Wyoming Pet Marketers Association and Convenience Store Association (CWPMA) does not have any questions or concerns regarding the new cage-free egg regulations in Colorado that go into effect on January 1, 2023.

To summarize, convenience store owners and restaurant owners are exempt from the new regulation if they purchase less than 750 dozen eggs per week if one store/restaurant is owned, or 3000 dozen eggs per week if multiple stores/restaurants are owned.  Any restaurant that only uses eggs in the preparation of a combination food product (for example cakes, breakfast burritos, sauces) and the eggs do not maintain their primary identity as eggs when served to customers, is also exempt.

There are Q & As on our website under the blue banners for Enclosure Requirements, Business Owner Requirements, and Record Keeping that you may find helpful.

Attached is a copy of the rule for your review.

In addition to that, Mark Gallegos, Division Director, and I would be happy to meet with your group if you would like to discuss any specific areas of concern for your members.
