New Compliance Webinar on Language Assistance Services for Retail Violations

FDA has posted a new webinar outlining language assistance services which are available for tobacco retailers who have received a Civil Money Penalty (CMP) or No-Tobacco-Sale Order (NTSO) Complaint from CTP. Retailers who have difficulty effectively communicating in English can request language assistance services to discuss CMP and NTSO Complaints.  

Generally, the first time FDA finds that a retailer has violated the law, the Agency issues a warning letter, an advisory action used to obtain compliance. If FDA finds subsequent violations at the retail establishment, it generally seeks a CMP in accordance with the schedule published in the Tobacco Control Act. If, after the issuance of a CMP Complaint, the retailer is found to have committed repeated violations, FDA can seek a NTSO that prohibits the sale of tobacco products at the retail outlet indefinitely or for a specified duration.

In response to receiving a CMP or NTSO Complaint, the retailer may pay the CMP or comply with the NTSO period sought, enter into a settlement agreement, or file a response and contest the CMP or NTSO Complaint.
