COLORADO - LEGISLATIVE UPDATE

Members, 

Our agenda Bill SB23-280 Hazardous Material Mitigation was introduced and made  out of the Senate. Want to thank John Drafts and Chairman Hill for coming and Testifying in committee. While the vote was partisan, the Republicans are helping in a lot of quiet ways relative to amendments and giving us an opportunity to make our case. Another bill to address our members concerns is HB23-1285 Store Use of Carryout Bags and Sustainable Products: https://leg.colorado.gov/bills/hb23-1285 - Currently, a store is required to collect a fee for each carryout bag the store provides to a customer. The store must remit a portion of that fee to the municipality or county (local government) in which the store is located. When the local government has not established a process to accept the remitted fees, the bill requires the store to retain and use the portion of the fee that would otherwise be remitted to a local government to purchase recycled paper carryout bags, 100% recycled cups, or compostable food containers. We shouldn’t have any trouble passing this legislation. And in communities that haven’t set up a remittance process, you all can use the fee to buy cups and things for your customers. The bill has passed out of the House and is scheduled in Senate Finance on 5/2.
