About FAMLI
WHAT: Colorado voters approved Proposition 118 in November of 2020, paving the way for a state-run Paid Family and Medical Leave Insurance (FAMLI) program.
WHO: CDLE is responsible for administering the program in Colorado.
WHEN: Premium collections will begin January 1, 2023. Employers and their employees will contribute to the program. Employers will be able to opt-out of the state program if they have a paid family leave program equal or greater to the benefits in the state program.
The FAMLI program will ensure all Colorado workers have access to paid leave in order to take care of themselves or their family during life circumstances that pull them away from their jobs — like growing their family or taking care of a loved one with a serious health condition. FAMLI will start providing benefits to employees beginning January 1, 2024. Both employers and employees will contribute premiums for the program. Employees may start to see a premium contribution on their pay stubs beginning January 1, 2023.

Q2 - Share information with employees and professional organizations AND Participate in ongoing rulemaking and user experience discovery/testing
Q3 - Register with FAMLI Division AND Update employee handbooks using model language from CDLE explaining payroll deductions
Q4 - Set up payroll deductions for premiums, beginning on January 1, 2023, OR Notify Division and provide documentation of private plans

FAMLI Division Regulatory Update
CDLE’s FAMLI Division has officially adopted the first set of administrative rules for the program, which went into effect this January 1, 2022. These rules cover premium collection, which will begin in January of 2023 – giving employers a full year to plan. The Division held a formal hearing on rules pertaining to local government on January 6th, 2022, and the formal comment period closed on January 10th, 2022 at 5 PM.
Current rules in development will outline both the FAMLI benefits and available options for private plans. We anticipate being able to share those and enter the formal rulemaking process on both sets of those rules this Spring, to give employers who wish to use a private plan 12-18 months of planning time before benefits begin in January of 2024.
